DUESENBURG, Inc. ----- LIMITED WARRANTY

Conditions

·          Seller shall not warranty or cover any loss or damage that may have occurred as a result of: misuse, neglect, or improper operation environment including as extreme heat or cold; repair or modification not done by a qualified repair technician that results in damage power surges or other electrical damages including static electricity; liquid spills on any components; smoke; physical abuse including dropping or hitting; incompatibilities with another vendor’s hardware or software; software setup or configuration problems.

·          To obtain warranty service. Buyer shall notify seller in person or in writing that warranty service is requested. In order to return merchandise fur refund or repair or to obtain telephone technical support. a proof of purchase must he provided. Proof of purchase is a invoice from the seller. All Seller warranty stickers must be appropriately affixed to obtain warranty service.

·          All products returned for replacement or refund must he it original and undamaged packaging, including all manuals. cables, disks. etc., with no customer writing on the box (e.g. “bad”). Buyer’s failure to provide original packaging may result in an additional restocking recur loss of refund eligibility.

·          If Buyer desires to ship parts to Seller, it is the Buyer’s responsibility to obtain a Refund Merchandise Authorization (RMA) number prior to shipping Merchandise should be shipped with adequate packaging and fully insured. Shipping costs are non-refundable.

·          Items left at Seller’s location for any reason over 60 days are considered abandoned and become the property of Seller, for disposal or any other purpose deemed appropriate by Seller.

Past due Accounts and Warranty

Buyer shall pay Seller interest on any delinquent payment or amount due under invoice agreement from the due date thereof until paid, at the greater of the maximum rate of interest allowed by law or 18% per annum.  In addition, Buyer shall pay to Seller any actual additional expense incurred by Seller in collection efforts, including but not limited to long distance telephone charges and travel expenses.  In the event of any legal action with respect to any unpaid invoice, Seller shall be entitled to reasonable attorney fees, including attorney fees incurred at the trial level, bankruptcy court, on appeal or review, or incurred without action, suits or proceedings, together with all costs and expenses incurred in pursuit thereof. The invoice date is the start of the warranty period. Any Buyer’s account deemed uncollectable by Seller will void all warranty obligations by Duesenburg. Any past due amount over 90 days will be sent for collection and or legal actions.

Force Majeure:
In the event that either party is delayed or hindered in or prevented from the performance of any required act by reason of strikes, lockouts, labor troubles, inability to procure materials, failure of power, restrictive governmental laws or regulations, riots, insurrections, war or other reason of a similar nature not the fault of the party delayed in performing work or doing acts required under the terms of this agreement, then performance of that act shall be excused for the period of the delay and the period for the performance of that act shall be extended for an equivalent period.

 

Parts and Components Warranty

CPUs, memory, video ram, and cache modules carry a seven (7) day functional warranty, during which time the Seller will provide an exchange for a defective product. All other new parts purchased from seller are covered by the manufacturers repair or replacement warranty, which may vary form ninety (90) days to three (3) years, but is generally accepted to be one (1) year from the date of purchase. During the first (30) days except for CPUs memory, video ram, and cache modules, Seller will provide a prompt replacement of any part that is found to be defective with the same or equivalent part. Printers are covered by the manufacturer warranty and Seller will provide a 30 day DOA warranty. Ink cartridges and other consumable items are not covered under Sellers warranty unless it is covered by the manufacturer. The manufacturers warranty is the only warranty provided for products sold. Seller, during the manufactures warranty period up to one year, will assist the customer in obtaining warranty service front the manufacturer.

Systems and Notebook Warranty

All new systems purchased from Seller are covered (1) to (3) years for replacement parts and (1) year for labor costs to restore the system to its original and intended condition. Seller’s responsibility is limited to repair or replacement of hardware components inside the system case, and does not cover Buyer’s additional software or data loss. If component part of a system or notebook is replaced or repaired by the manufacturer. Seller will install the part at no additional charge. Seller labor and parts warranty does not include parts brought from other companies or not installed by Seller. Mice, keyboards, scanners, printers, monitors, and other peripheral units are not covered under this replacement parts warranty but are classified as “parts” and are covered under appropriate manufacturer warranty. After the (I) year labor warranty, seller will replace defective parts at the Seller’s standard labor rates, Notebook computers purchased by buyer are covered by manufacturer warranty and should utilize manufacturer warranty service (generally I-8OO numbers) before contacting seller for warranty assistance.

 

For All New Systems and Parts

ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED AND EXCLUDED HEREFROM IN NO EVENT SHALL SELLER BE LIABLE FOR LOSS OF USE OR FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES,  INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL DAMAGES FOR PERSONAL INJURIES. THE FOREGOING LIMITATION OF LIABILITY SHALL  APPLY WHETHER ANY CLAIMS IS BASED ON PRINCIPLES OF CONTRACT, WARRANTY. NEGLIGENCE OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, THE FAILUR OF ANY LIMITED OR EXCLUSIVE REMEDY TO  ACHIEVE ITS ESSENTIAL PURPOSE OR OTHERWISE NOTHING HEREIN SHALL BY CONSTRUED AS SELLER ADOPTION ANY MANUFACTURER WARRANTY.

 

Return and Refund Policy

1.    Parts designated as “special Order” one the invoice are not returnable. CPUs are not returnable for a refund.

2.    All systems and other pasts are returnable within twenty (20) days from date of purchase provided they meet the conditions stated above,

3.    All systems and parts may he returned for a cash refund less appropriate restocking fee as listed below, or full in-store credit, provided the credit is used within seven (7) days from the return date.

4.    All parts may be returned from a cash refund less a 15% restocking fee of the current selling price.

5.    All systems may be returned for a cash refund less a 20% restocking fee of the current selling price.

6.    All refunds over $50 shall be issued by check within seven (7) days train the date the system or product is returned, except for credit card purchases with will be credit to the Buyer’s account. Purchases made by check will be refunded after the check clears to the Seller’s bank.

7.    All labor, service, deposits, and shipping charges are nonrefundable.

 

Entire Agreement

The Buyer is hereby referenced on the reverse side of this document (invoice) as the person or entity listed in the upper-left hand corner. Seller is Duesenburg Inc,.. An Indiana based company. This contract and the exhibits and attachments set forth all the covenants, provisions, agreements, conditions and understandings between the parties and there are no other covenants, promises, agreements, conditions or understandings, either oral or written, between them

Terms and Condition

 

Duesenburg provides Internet World Wide Web page hosting, Marketing, and Development. Duesenburg has certain legal and ethical responsibilities consisting with the use of its server and equipment involved in these services.

 

Duesenburg general policy is to act as a provider of Internet presence. Duesenburg has specific ethical concerns regarding the use of its computers detailed below. Duesenburg reserves the right to suspend or cancel a customer’s access to any or all services provided by Duesenburg when we decide that the account has been inappropriately used.

 

Server Abuse

 

Any attempt to undermine or cause harm to a server, or customer, of Duesenburg is strictly prohibited.

 

Unauthorized use of other people’s accounts or computers Duesenburg will strongly react to any use or attempted use of an Internet account or computer without the owner’s authorization. Such attempts Include “Internet scamming” (tricking other people into releasing their passwords), password robbery, security hole scanning etc.

 

Any unauthorized use of accounts or computers by a Duesenburg customer, whether or not the attacked account or computer belongs to Duesenburg, will result In action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

 

IMPORTANT NOTE - Duesenburg has the right to discontinue service, or deny access to anyone who violates our Policies or the terms and conditions shown below WITHOUT WARNING OR PRIOR NOTICE. No refunds of fees paid will be made if account termination is due to violation of the terms outlined below.

 

Customers may not run IRC, bots or clients. Unacceptable uses also include, but are NOT limited to: Bulk emailing, unsolicited emailing, newsgroup spammlng, pornographic content, illegal content, copyright infringement, trademark Infringement, warez, cracks, software serial numbers, and/or anything else determined by Duesenburg to be unacceptable use of Duesenburg’s services including abuse of server resources.

 

Accounts may be terminated that include the following content or which have links to the following content:

 

            Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism, hatred, or profanity

            Promoting or providing instructional information about illegal activities, or promoting physical harm or injury against any group or individual

 

            Displaying material containing obscene nudity or pornographic material

 

            Displaying material that exploits children under 18 years of age

 

           Acts of copyright infringement including offering pirated computer programs or links to such programs, information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities

 

Abuse of Unlimited Traffic

 Duesenburg’s customers are privileged to be offered unlimited traffic for their web sites. The intention of Duesenburg is to provide a large space to serve web documents, not an off site storage area for electronic files. All (90%) of your web pages (html) must be ‘linked’ with files (.GIF, JPEG, etc.) stored on Duesenburg’s server. Web sites that are found to contain either/or no html documents, a large number of unlinked files are subject to warning, suspension or cancellation at the discretion of Duesenburg management. Any customer who violates Duesenburg’s Policies in abusing either space/site transfer will be notified and given 2 days to remedy the problem. If the problem is not resolved within the allotted period, the client will be billed for the overages.

 To maintain the integrity of our service the following limitations apply:

 Sites with banners, graphics or cgi scripts running from their domain used on other domains. Sites with picture galleries (This is any site where 50% of the files transferred is graphics) Sites offering download files or archives. (This is any site where 50% or more of there monthly traffic is from file downloads). Sites using more than 30% of system resources for longer than 60 seconds. Sites running multimedia files (QuickTime, Real Audio, Real Video, MP3).

 For those that do not qualify for the unlimited service, traffic will go unmonitored until you reach 20 GB per month. Thereafter, normal data transfer cost of $20.00/1GB/month will be billed to your account. If you want to pre-pay for bandwidth averages, you will be billed $10.OOI1GB/month. You will receive a notice on Tuesday morning detailing your bandwidth usage. You will have 7 days to visit www.overages.duesenburg.com (or email billing) to pay for your averages. If you do not pay for your averages your site will be disabled within 7 days of your first notice.

 Duesenburg will be the sole arbiter as to what constitutes a violation of this provision.

 Unsolicited Email (Spam)

 unsolicited commercial advertisements are not allowed In e-mail, and will likely result in account suspension or cancellation. Commercial advertisements are unwelcome in mast Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list’s charter for whether advertising is allowed or not. “Spamming,” or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such. Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium. Upon your first Spam offense your mail will be disabled for 72 hours. Upon your second Spam offense your entire domain will be disabled for 72 hours and you will be fined $100.00 per sent Spam. Upon your third offense your account with Duesenburg will be terminated, you will be fined $200.00 per sent Spam. No refunds will be given if your account is terminated for Spam.

 99.9% Uptime Guarantee

 (1.) Coverage

This 99.9% uptime guarantee applies to any Duesenburg client in good financial standing with Duesenburg at the time of a service outage,

 (2.) Service Level

Duesenburg endeavors to have the content of your web site available for http access by any party in the world 99.90/a of the time.

 (3.) Credits

In the event that your web site Is not available for more than 99.9%, Duesenburg will credit the following month’s service fee as follows. For any shared hosting client, such credit shall be retroactive and shall be as calculated below and as measured 24 hours a day in a calendar month, with the maximum credit not to exceed the monthly service charge for the affected month.

 For managed dedicated server customers if the uptime is between 98.9% and 99.9% for any particular month the credit shall be retroactive and equivalent to the difference between the guaranteed level of availability of the customer’s services during the month and the calculated actual level of availability of the customer’s services, multiplied by the actual charges incurred by the customer for the services during that month period. In addition, for managed dedicated server, customers may be entitled to additional credits as calculated below and as measured 24-hours a day In a calendar month, with the maximum credit not to exceed fifty percent (50%) of the monthly service charge for the affected month.

 In order for you to receive a credit on your account, you must request such credit within ten (10) days after you experienced the down time. You must request credit by sending an electronic mail message to refunds@duesenburg.com. For security, the body of this message must contain your account number, the dates and times of the unavailability of your website, and such other customer identification requested by Duesenburg. Credits will usually be applied within sixty (60) days of your credit request. Credit to your account shall be your sole and exclusive remedy in the event of an outage.

(4.) Restrictions

Credits shall not be provided to you in the event that you have any outage resulting from (1.) scheduled maintenance as posted from time to time at Duesenburg, (2.) your behavior or the performance or failure of your equipment, facilities or applications, or (3.) circumstances beyond Duesenburg’s reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services, including DNS propagation, domain name registration transfer, failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of your web site, or (4.) a client breaking any item in Duesenburg’s “terms of conditions and acceptable use policy” causing a machine to fail as a result.

CGI Scripts

Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning.

Chat Rooms

We do not allow clients to Install their own chat rooms, without approving It with the Duesenburg Support Team. Most chat rooms tend to be large system hogs and we cannot allow it as an account option. However, we do provide a choice of Java chat rooms for a small extra charge that will more than fill your needs and run without hindering the performance of the machine for others. Note:

Parachat chat rooms do not apply to this rule. They are perfectly fine to install.

Abuse of SMTP Mail Server

We do not allow clients to send more than 2000 pieces of e-mail per day. If you do send more than 2000 pieces of e-mail per day, your account will be placed on hold for Network Abuse. If you are sending legitimate e-mails and they total more than 2000 per day your account will be moved to a special server that is specifically designed to handle high volumes of e-mail. You will be charged $50.00/month in addition to your regular hosting charges if your account is moved to this server. Please contact cs@duesenburg.net in to have your domain moved.

Background Running Programs

We may allow programs to run continually in the background. These are considered on a one-to-one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

IRC

We currently do not allow IRC or IRC bats to be operated on our servers.

12 Hour Guarantee

The 12 hour guarantee for new domain setups only applies to the following accounts: Starter-Unix, Basics-Unix, Graduate-Unix, Creator-Unix, Innovator-Unix, Web Commerce - Pro, Web Commerce - Lite, and Host.one.

Payment Policies

All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. Duesenburg reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Duesenburg at cancel.duesenburg.com to request for termination of services. All payment is in U.S. currency. Duesenburg will bill each client $50 per returned check and $50 per wire transfer received.

Cancellation

Duesenburg reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Duesenburg if Duesenburg institutes it’s right of cancellation. Any violation of policies which results In extra costs will be billed to the customer (i.e. transfer, space etc.)

All of Duesenburg’s web hosting plans are backed by a 30 day money back guarantee. If you are not completely satisfied with our services or support within the first 30 days of your contract, you will be given a full refund of the contract amount excluding setup fees and averages. Setup fees are refundable only If the account order is canceled prior to activation. For web hosting contracts of 3 months or less, the full contract amount less any setup fees and overages will be refunded if Duesenburg Is notified within the first 30 days following activation. No refund is available after the 30th day. This policy does not apply to any additional services such as averages, referrer logs, real audio/video, additional disk space, additional pop accounts, etc. Due to security concerns, all account cancellations must be done via our cancellation form. Phone or email requests will not constitute acceptance of any cancellation. Refunds will be made by company check or issued back to your credit card within 30 days of receipt of cancellation.

Lawful Purpose

Duesenburg reserves the right to refuse service to anyone. Customers may only use Duesenburg server for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. The designation of any materials as such described above is left entirely to the discretion of Duesenburg management. Regardless of the place of signing this agreement, the client agrees that for purposes of venue this contract was entered into in Allen County, Indiana, and any dispute will be litigated or arbitrated in Allen County, Indiana..

 Indemnification

CUSTOMER AGREES THAT IT SHALL DEFEND, INDEMNIFY, SAVE AND HOLD DUESENBURG HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATORNEY’S FEES ASSERTED AGAINST DUESENBURG, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD BY CUSTOMER, IT’S AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS DUESENBURG AGAINST LIABILITIES ARISING OUT OF; (1) ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH DUESENBURG’S SERVER; (2) ANY MATERIAL

SUPPLIED BY CUSTOMER INFRINGING OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY; (3) COPYRIGHT INFRINGEMENT AND (4) ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM DUESENBURG’S SERVER.

DUESENBURG WILL NOT BE RESPONSIBLE FOR ANY DAMAGES YOUR BUSINESS MAY SUFFER. DUESENBURG MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. DUESENBURG DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY DUESENBURG AND ITS EMPLOYEES. DUESENBURG RESERVES THE RIGHT TO REVISE ITS POLICIES AT ANY TIME.

ALL SUB-NETWORKS, RESELLERS AND DEDICATED SERVERS OF DUESENBURG MUST ADHERE TO THE ABOVE POLICIES. FAILURE TO FOLLOW ANY TERM OR CONDITION WILL BE GROUNDS FOR IMMEDIATE ACCOUNT DEACTIVATION.

Duesenburg follows the strict guidelines of our customer privacy statement. Please make sure you understand this statement fully.

Your privacy is important to us. We want you to feel comfortable using Duesenburg services. Because we gather certain types of information about the users of Duesenburg's services, we feel you should fully understand what information we gather and how we use that information. Duesenburg employees are required to familiarize themselves with this privacy policy as a condition of their employment, and any employee violating the policy is subject to disciplinary action.

What Information Does Duesenburg Gather?

When you register for a Duesenburg account, Duesenburg obtains contact information, such as your name, address, and phone number, as well as payment information, such as your credit card number. When you use Duesenburg's service, our systems record information about your session, such as the dates and times of use, and the specific Internet address assigned to you. Duesenburg also tracks requests you make for information on Duesenburg's products and services, and responses you provide to Duesenburg surveys. Finally, Duesenburg keeps records of your payment history and communications you have with Duesenburg's support team. Except in extraordinary circumstances (when we receive a court order, to protect the company's rights or property, or in emergencies where someone's safety is at risk), Duesenburg does not keep track of what sites you visit when you are using the service.

What Does Duesenburg Do With This Information?

Duesenburg uses the information it gathers in order to provide you with the best online experience possible. As you might expect, contact information is used to contact you concerning your account and our company. Payment information is used to validate your identity and to bill you for the services and products you order. Information on your online sessions is used to allocate system resources and to ensure compliance with Duesenburg's Terms and Conditions of Use. Information on your communications with Duesenburg's support team is used to address the issues raised by your communications. In addition, Duesenburg regularly sends out mailings regarding the operation of its service and other goods and services that it believes may be of interest to you. You may request that Duesenburg not send you mailings relating to other goods and services at the URLs listed in this section or send an e-mail to privacy@duesenburg.net. Duesenburg reserves the right, however, to send bulletins and other important information regarding the service at its discretion.

Does Duesenburg Share Subscriber Information With Third Parties?

Duesenburg will not share or disclose information regarding its subscribers except (i) when we receive legal process such as a court order; (ii) when reasonably necessary to protect the company's rights or property; or (iii) in emergencies where someone's safety is at risk.

You should be aware, however, that any information that you disclose in a public space such as a chat room, bulletin board, or personal Web site, Network Solutions domain registration is freely available to anyone else visiting that space. Duesenburg cannot safeguard any personally identifiable information you disclose in these locations, nor can it ensure that information you voluntarily supply to third parties remains private. Please review the privacy policies of third party sites you frequent to ensure that your privacy preferences are respected.

How Can I Correct or Update the Information?

To request a copy of the contact Duesenburg has on your account, send an e-mail request to privacy@duesenburg.net. You may correct that information as appropriate by returning a message to the same address. Please keep in mind that under Duesenburg's Terms and Conditions of Use, subscribers are required to provide Duesenburg with current contact and billing information. Duesenburg may require a copy of a government issued form of identification before disclosing billing information or before making changes to the billing or contact information on an account.

What Happens to the Information if I Leave Duesenburg?

If you ever leave Duesenburg, Duesenburg will normally delete your personally identifiable account information twelve months after the account is cancelled, unless we are under a legal obligation to retain it. We preserve account information for this short period of time in the event you wish to reactivate your account and retain your previous e-mail address. However, in the event of any accounting irregularities, Duesenburg reserves the right to retain your contact and billing information as necessary to resolve the matter.

Changes to This Policy and Questions About Privacy

Duesenburg reserves the right to make changes to this policy. Those changes will become effective 30 days after notice of them is posted here. If you have any questions about this privacy policy, please send them via e-mail to privacy@duesenburg.com.

Intellectual Property Rights

Material accessible to you through Duesenburg’s services may be subject to protection under the United States or other copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except when expressly permitted by the owner of such rights, you must not use Duesenburg or Its servers and network in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through the Duesenburg network. Network Security

Customers may not use the Duesenburg network with an attempt to circumvent user authentication or security of any host, network, or account. This Includes, but Is not limited to, accessing data not intended for the customer, logging Into a server or account the customer is not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization’s security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but Is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Duesenburg will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may ocur criminal or civil liability.
